California Ends Money-based Bail Bond System 08-28-2018 1500 DC

California today became the first state in the nation to end bail before trial. The state is replacing money bail with a risk assessment system intended to keep serious offenders in jail while releasing the rest.

The new law signed today/Tuesday by Governor Jerry Brown becomes effective in October 2019.

Before then, there are many details to be worked out, but the law means most people arrested on misdemeanor charges will be out of jail in 12 hours or less. Proponents say getting rid of money bail will especially help poor defendants who today often remain in jail because they cannot afford to make bail. Opponents are concerned released prisoners won’t return for trial. Others worry doing away with bail gives judges too much authority.

The state’s Judicial Council will establish policies and procedures of the program. But counties will be responsible for implementation and have a large role to play.

Other states have changed their bail system, but California is the first to do away with bail.
