Efforts to suppress evidence from a 2013 Capitola murder case have been denied. Diana Cohen, and her son Daniel Cohen, are suspected of shooting and killing their property manager, Jonathan Gordon Smith on November 9th of 2013. On monday, the defense attorney for the Cohens argued that they were arrested illegally, and searched without a warrant. However, the judge agreed with prosecutor Celia Rowland, who stated that the Cohens were detained, and not arrested. The robbery and murder trial for the Cohens is now scheduled to begin March 30th.
