A judge in Sutter County that Gov. Gavin Newsom exceeded his authority when he ordered that all Californians receive mail-in ballots for the Nov. 3 general election. The judge also preliminarily ordered the governor to stop issuing directives related to the pandemic that might interfere with state law.
The lawsuit stemmed from an executive order issued before the legislature passed a similar law. Two GOP Assembly members sued. They claimed the governor has no authority to issue the order.
The governor’s lawyers claimed in court that, since the legislature passed a bill, the entire issue was moot.
The ruling has no impact on this week’s election.
